 YOUR PRESENTENCE REPORT (PSR)

The PRESENTENCE REPORT (PSR) IS YOUR  “REFERRAL FOR

  1. MEDICAL CARE
  2. SECURITY LEVEL (FREEDOM OF MOVEMENT), WHETHER YOU END UP AT A CAMP OR USP.
  3. IT CONTROLS ALL ASPECTS OF YOUR LIFE AND IMMEDIATE FUTURE.
  4. ITS ACCURACY AND COMPLETENESS CANNOT BE OVERSTATED.
  5. REDOS ARE FEW, EXPENSIVE, AND A HEAVY LIFT.
  6. IT DEPENDS ON COMPREHENSIVE PREPARATION FOR YOUR PRESENTENCE INTERVIEW.
  7. PROVIDING ALL OF THE CONTENT REQUESTED, ORGANIZED AND SPELLCHECKED
    • ALONG WITH A NARRATIVE, CHARACTER LETTERS AND RELEASE PLAN,
    • 1-2 WEEKS BEFORE YOUR INTERVIEW DATE.

  1. PROVIDE ALL COPIES OF YOUR BIOGRAPHICAL BACKGROUND AND PERSONAL I.D. 
  2. IT IS RECOMMENDED THAT YOU SPEND TIME SELF-REFLECTING,
    • THEN, WRITE YOUR AUTOBIOGRAPHY OR LIFE STORY AND EXPLAIN WHAT CAUSED YOU TO BREAK THE LAW WITHOUT EXCUSES, ACCEPTING RESPONSIBILITY AND HAVING REMORSE FOR THE VICTIMS YOU HAVE HARMED.
    • WHY?
      • DID YOU LIKE YOUR FEDERAL INDICTMENT?
      • THE DOJ WROTE YOUR NARRATIVE (OR STORY) FOR YOU.
      • TO COUNTER IT, NOW IS THE TIME TO WRITE A WELL-WRITTEN PERSONAL NARRATIVE.
    • HOW DO YOU GO ABOUT WRITING IT?
  3. CHARACTER REFERENCE LETTERS
    • They include the fact that they know you have broken the law and have known you for a long time. They can come from family, friends, community, or religious leaders. They are ‘not’ offering sentencing recommendations to your judge.
    • Should an employer be willing to write a letter that states they are willing to rehire you after release from prison due to your ‘character and skills’ – that is a Great letter and should be included in your Presentence Report, Memorandum, and Release Plan. They may write, “I know he/she won’t be back to this court because we will be looking out for them in the future and holding them accountable.”


  1. EXAMPLE.
    • The ‘writer’ states that they know that you are in trouble and facing federal charges and that you have remorse for the victims you have harmed. They have known you for 40+ years, “We went to college together, and this is so out of character for you,” and they know you want to make amends. “I know he/she won’t return to this court because we will look out for them in the future, supporting and holding them accountable.”
    • You know that the defendant’s loss of professional license devastated him/her, and it is unlikely that he/she will be unable to pursue their lifelong dream of practicing in a field they love. You will consider paying them a high minimum wage; they would work five days/week, 8 hours a day, and are available for sudden Probation Officer visits.
    • Additionally, as the owner, either I or my managers will be available should probation call or stop by to verify their work.
  2. Halfway House Job Letter Should Include,
    • They know you are going to prison, that you have just been released, and they are still willing to hire you.
    • Your job will keep you in one place where probation can call or show up and find you.
    • Your pay will be $/ Hour, 5 Days/ week, 8 hours / Day. It includes your manager’s name and phone number and states they can speak with Halfway House and Probation as needed.
    • How they know you and how long they’ve known you.
    • What do they think of you?
  3. Who do you ask:
    • Relatives, Religious leaders, Volunteer organizations, or employers (especially if they are willing to rehire you)?
    • Request Character letters and keep reminding the people you’re asking, then pick the ten best. Then, give them all to your lawyer at one time. Do not include personal information (phone, address); for businesses, that is OK.
    • Start asking for these letters ASAP.


Judges understand that crimes do not happen in a vacuum. They are also very interested in hearing from you, the defendant, in your own words. What happened – that caused you to break the law? Include the significant parts of your life and the low points, omitting nothing. Include The Good, The Bad, and The Ugly. I hope you find this video helpful.

  • Judges use the PSR to determine the length of a sentence.
  • The Bureau of Prisons (BOP) uses the same PSR for prison placement.
