INMATE FINANCIAL RESPONSIBILITY PROGRAM PROPOSAL 12-2024

The Federal Register: THIS WILL AFFECT YOU.

MY OPINION

I. FSA AND EARLY RELEASE

The intent of the FSA, Briefly, was to 1) save the BOP money by releasing inmates early should they be eligible, 2) allow inmates to take Evidence-Based Recidivism Reduction Programs and Productive Activities to reduce Criminogenic Tendencies, 3) have them reenter society as contributing members. For the most part, the statistics have shown this to be accurate.

You will no longer have FSA if you refuse to participate in the FRP Program, No Credits toward Up to 1 Year toward Early Release, No RDAP toward Up to 1 Year toward Early Release, No early Halfway House time or Home Confinement—also, very limited Commissary.

II. THE BOP

The BOP wants people-inmates to take the FSA programs and then spend their commissary money buying things. Why? Because they depend on those funds to plan their budgets.

III. DOJ.

The DOJ may need an excuse to propose a law (maybe) to confiscate that 75% of your commissary account.

Procedures

  • None of your outside money would be touched if the % of your commissary account is under $250.00;
  • 25% if your account balance is $250.00 but under $1,000.00;
  • 35% for accounts from $1,000.00 but under $2,500.00;
  • 55% from $2,500.00 but under $5,000.00; and
  • 100% of outside money when your balance is over $5,000.00.

Refuse to participate in the IFRP program – IS A BAD IDEA.

  • Denies an inmate anything more than about $5.00 a month pay for work,
  • A severely limited commissary list from which to buy food and consumer goods,
  • No RDAP “year off” credit and
  • No halfway house or home confinement (among other restrictions).

The Supplemental NPRM proposes adding to that list

  • No FSA credit, meaning that an inmate would be stripped of the ability to take up to a year off his or her sentence and
  • No extra time in the house or home confinement time.
