We are undergoing a major democratic upheaval that profoundly affects our government, its agencies, and our personal lives like never before. During this challenging time, your clients are understandably filled with anxiety as they confront the prospect of incarceration.

It’s essential to acknowledge your fears while providing reassurance and guidance.

Several truths coexist: 1) He enacted the First Step Act, which we hope he will expand, allowing credits to be applied with the Second Chance Act toward an earlier release. 2) Prisons, overcrowded and understaffed, now must accept ICE detainees, mixing them with inmates. 3) Inmate and staff morale, while low, must endure. 4) It’s possible that eligible minimum inmates could be released to HH or HC earlier; just a thought.

The BOP has been assigned new (ICE) responsibilities related to housing detainees. In addition to multiple BOP Facilities (FPC Morgantown, FDC in Miami, FCI Atlanta, Dublin, and Berlin), ICE is also opening Private Prisons. This represents a significant shift from the BOP’s traditional role of housing only convicted criminals.

Prepare thoroughly for your Presentence Interview by gathering a Narrative, Release Plan, Medical File (if needed), Character Support Letters, and any other requested documents.

Enter with a Planned Daily Routine that includes programs to take, an Assessment Survey to complete, books to read, and a log to document activities, conversations with staff, and insights gained from FSA Programs and reading. Note if you taught a class as well.
This will serve as your Life Insurance Packet while in the BOP or until your Supervised Release ends.

Are you eligible for RDAP and FSA Programs?

The Second Chance Act of 2007 (SCA) allows prisoners to receive up to one year of halfway house or home confinement, regardless of their offense or history. This act is mandatory for all prisoners, who must undergo an individual assessment to determine the length of their placement. The SCA, reauthorized by the First Step Act of 2018, can be combined with the Residential Drug Abuse Program (RDAP) to further reduce your time in prison. It is officially cited as Public Law 110-199, also known as the Community Safety Through Recidivism Prevention.

The Administrative Remedy Process

The BOP strongly urges all inmates to take full advantage of the Administrative Remedy Process to address any grievances. While not the most transparent or efficient system, it remains the primary avenue available and has proven effective in resolving some issues.
